1. Acceptance of Terms

By accessing and using Genz Property Listing ("the Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. User Accounts

To access certain features of the Platform, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately if you discover or suspect any security breaches
• Take responsibility for all activities that occur under your account

3. Property Listings

Users who list properties on our Platform agree to the following:

• Provide accurate and truthful information about properties
• Not list properties you do not have the right to sell or rent
• Not engage in fraudulent, misleading, or deceptive practices
• Comply with all applicable laws and regulations regarding property transactions
• Free users are limited to 3 active property listings at any time

4. Premium Membership

Premium membership offers additional benefits including:

• Unlimited property listings
• Featured property placement
• Priority customer support
• Advanced analytics and insights

Premium membership fees are non-refundable except as required by law. We reserve the right to modify membership fees with 30 days' notice.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Posting false, inaccurate, or misleading information
• Harassing, abusing, or harming another person
• Using the Platform for any illegal purpose
• Collecting or harvesting any information from the Platform
• Interfering with the proper working of the Platform
• Bypassing measures we may use to prevent or restrict access
• Engaging in any discriminatory practices prohibited by Kenyan law

6. Intellectual Property

The Platform and its original content, features, and functionality are owned by Genz Property Listing and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform without express written permission from us.

7. User Content

By posting content on our Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with the Platform.

You represent and warrant that you own or have the necessary rights to the content you post and that such content does not violate these Terms.

8. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform.

9. Limitation of Liability

In no event shall Genz Property Listing, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use or alteration of your transmissions or content

10. Disclaimer

Genz Property Listing is a property listing platform that connects clients with property owners. We do not facilitate bookings, payments, or any transactions on behalf of property owners. All agreements, payments, and arrangements between clients and property owners must be made independently outside of this platform.

There are no booking or payment buttons on this website, and we do not take responsibility for any transactions or agreements made outside of the platform. Users acknowledge that Genz Property Listing only provides information about listed properties and does not act as an intermediary or agent in any property transaction.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
